Dealership Warranty. F&*K

Post by aznfto »

Im feeling really angry and frustrated. Story is i bought my black manual FTO (1996?) from a dealership, had 61,XXX on the odemeter and cost $12,000 which i sorta doubted but still insisted. Also got 6months rego and 2 years warranty or something. Car has had poblems such as 5th gear not working which they've been putting off because the 'part' has not arrived to fix it and just recently a horrid smell has arisen and the car lost all its power so i barely make it back to the dealers and the've taken a look at it and say that it'll cost $1300+ to fix because im not covered under warranty and all his bullcrap. I look at the warranty book i got and it says the 'clutch' is covered but im being charged $1300 for clutch kit, machine flywheel and labor ($800) >.>. I've planning to make a complaint with the office of fair trading and maybe thinking bout getting another car because, well its just so frustrating. :(
Is annyone able to give some advice on the matter because im abit confused and dont like dealing with this dealership >.>

Does it say anything anal about what parts on the clutch is covered or the whole clutch is covered? They can get you on stuff like that depending on how its written. Or it could be covered up to $50 on the whole clutch or something like that.

They get you on the clutch because they call it "consumables" because clutches wear out (ive been caught on this myself). Having said that, while the clutch is a consumable, the flywheel should be covered by the warranty as they do not wear out. And as the flywheel is damaged, pulling apart gearbox should be covered by warranty. At the very least, threaten to take them to fair trading unless they come to the party. Would think that at the least they would cover half the costs. Also get a breakdown of the costs and get an alternative quote. If they dont match up fairly closely, thats more ammo.

the warranty book jus says clutch is covered, but the dealership owner himself told me it wasnt. i went home and looked at the book and im gonna go ask them i suppose.
i think in the book it mentions that if i get sumwhere else to repair it it'll void the warranty, not too sure.
and its pretty much stuck at the dealership, so if i was to bring it elsewhere needa get it towed.
its really frustrating cause i was only begining to redo the interior to my likings :(

generally, they can threaten to void the warranty on you if you take it anywhere else, but that is complete crap. They cant stop you from getting it service/fixed somewhere else as long as its a registered service centre. Its a ploy a lot of car dealers try on to get extra cash out of you in the event that something goes wrong. Honestly, give fair trading a call. Its just a telephone call and they will set you straight as far as what rights you have. If it was a private sale, youd have no recourse, but a dealer has to comply with a standard set of guidelines or they will get their licence revoked.

They can say that, but they cant enforce it if you decide to push it. All you need to do is to threaten to take them to consumer affairs and they normally buckle.
