Speeding fine due to emergency vehicle
I think I got a speeding fine due an ambulance driving behind me. The situation was like this:
I was driving along springvale rd towards glen waverley just pass the princess hwy intersection, it was a 70km zone. I was on the right lane, in the middle lane was a truck and in front of me was another truck and behind me was another car. My turn was coming up on the right (Mackie rd) but then I saw an ambulance speeding (about 50m away) towards the car behind me, i saw the car behind me turn into the middle lane behind the truck so I decided to to overtake the truck in the middle lane because i was in his blind spot so I speeded up to 80km but there was a mobile speed camera, I saw it and stopped stepping on the accelerator pedal (still in the right lane with speedo reading 80km), by then the ambulance was right behind my ass (about 2 metres away) but my turn was coming up so i turned right. But before i turned right I think the camera got me driving at 80km.
My question is do they give any leniency to speeding in the situation I just describe?

Send it in
Yep,
Send in your case in writing (hopefully you have a good driving record and can say - Look at my record). I got off one like this in the past. My wife was in day surgery, my Father in Law broke his arm and lost his wallet on the way to hospital (and needed cash) and my 2yr old needed to be picked up from child care (was sick). Was just a little distracted and got caught going 80 in a 70 zone.
Good luck

Even if theres a truck in the photo you can get off
They mess up the readings. And it works on 10% + 2km, so if you were only doing 79 you get off scott free regardless.
But if you do get the fine, as already stated, just tell them in writing what happened.
You may want to write it down now so the details don't get hazy.

Oh sweet, I'll write to them if I get the fine. Thanks for the advice guys. Much appreciate it.
I don't understand the rules regarding emergency vehicles. I know that your suppose to give way but are your allowed to speed, run a red light, go on the curb etc just to avoid them. Might check out the VIC roads website.

for fixed speed camera's in vic its roughly +9kmph I am told in all speed zones. I remember setting up a fix speed in the M4 in nsw at +2% and I got like 5000 photos per day...and the PCs fell over lol...10% turned out to be a good numbder and I think is some legislation about this now..
I setup heaps of fix speed in NSW in the early days and I know what the fixed speeds are set to in Vic. and its ranges from about 9% to 5% However for mobile cameras its differnent and +3kmph cos of tollerence of the radars/lasers depending on who is doing it. Now on a police radar gun case I would argue a number of points as depending on where they were standing in relation to you and the distance there is all kinds off issues!! go the cosine effect..
you wanna know more...over a few beers.
wanna know how to dodge your electricty account?? lol thats in DIY-2. I'm excitied by electricty...

I wouldnt be quoting me in court but this is my understanding of radar guns and speeding fines.
the coppers shouldnt legally be able to charge you if your within 10%. its all based on equipment tolerance. The radar gun is engineered such that there is an allowed tolerace of +/- 5%. Eg the gun can be 5% over or under if calibrated properly. It is the same for the speedo on your car.
These tolerances are based on australian engineering standards to which coppers subscribe. Therefore you should have a 10% leeway no matter what.
There are other factors as well, for example a radar gun cannot be used on a road with a gradient (not sure of gradient though) because there is forwards movement of the car as well as vertical movement, which the gun picks up. There are other escapes as well but im not sure. you will have to read the radar gun manual.
At least, thats how i understand it all works. Correct me if i'm wrong or you are a copper

radar or laser? lasers are only accurate to +/- 3kmph. so the man. specs say regardless of aussie stds.
radar's well thats a different story..most mobile vans use radar and they have designated spots which have been tested etc...i.e. why they always turn up in the same spot they are more accurate than 10% if setup correctly. remember that they always round down based on the tollerence..and its less than 10% for sure, more like 2%. To make it easy during testing +/- 2kmph is used by the RTA for example when they sign off fixed speeds with their radar gun equiped cars. i.e. radar says 62 u say 60 on the fix speed it will pass...gives u some idea of the differences n the tolerences not 60 and 66! (lol if your in vic cos there was a recent case where the guy did it on the wrong side of the road and he'd been going to that site for like 5 years ?? omfg!!)
So you reckon your doing b/w 95/105 when your sitting on 100...I don't think so. the tolerenecs are not that great. I managed to get exactly the same speed readings form a laser/radar and my speedo which was hooked upto a massive sign on my roof..
just don't speed...or better yet just don't get caught and if u do make sure your doing under 30 over or your interstate...I got busted on Paramatta rd 2 years ago in a new 325 BMW at 130 clocked by the coppers he said it was too much of an issue cos I was form Vic...aparently cos Vic roads and the RTA are not linked at all..its like a seperate universe altogether....hehe and we r in the information age..
