Okay, so throughout my studies in Law, I now have an assignment that must focus on a victimless law (nobody directly affected by offense), and question its social function within the community...

HERE'S THE QUESTION FOR YOU ALL;

Do the current vehicle modification laws perform a social function within the community?


I know most if not all of us have at least a minor dispute with these laws, so give me some examples and try and justify any social function you think the laws may perform! I must NOT be biased in this essay, so I need arguments supporting both for and against...

I could give a hypothetical 'what if' on the consequences of others doing ones work in a situation that in the future determines the outcome of peoples lives.

If work cannot be done by the person who is responsible to do it, then that person should not attempt it.

i.e. I know not to hire you as my lawyer. :P :lol:

On a more serious note, I believe you should be doing research on previous threads, no isolated to this forum, and see how people react to such things as.
Exhaust level requirement.
P plate mods limitations and why.
etc.

Not sure if I've the right idea of it, but I remember being on my P plates and thinking it a little inconsistent that modifications to improve engine performance were illegal, but I could still drive a powerful stock car. i.e. putting a pod on my 1.8L four banger was a no-no when I could drive a commodore with a considerable amount more horsepower.

And the laws are inconsistent, plagued with grey areas and dont make any sense a lot of the time.

While I can understand stopping Habib from having a fully sick rexie with a 5 inch exhaust (likely to be from a truck :troll:) that is like 100 decibels, why are modifications like tinting tail lights (without dimming any brake, reverse or indicator lights when they are being activated) illegal?

Well then set up a survey with proper questions etc, (use survey monkey) and then gather the results. You'll never get anything worthwhile doing it this way.
Plus survey monkey will give you statistics to use. survey results are always more believable with percentages ;)

To answer your question:

yes they do. The main basis for them is they prevent unsafe modifications which inadvertently affect other road users.

Statistically young drivers are more likely to be in an accident even without modifications.
Young drivers are normally the ones who perform modifications to vehicle and more often illegal ones. This with inexperience increases the affect it has on society as it puts innocent people and property in danger.

Something as simple as illegal window tinting, at night, trying to reverse and having poor visibility- you never know what or who you could hit, injure or kill. This affects the community.

EG: If you hit a person you injure or kill them. Clearly this would affect an individual, family, friends, a local community society, etc.

If you hit property and damage it. This affects the individual party(ies) commercial and personal enterprise, communities and society in the form of levies, premiums, excesses (Sub-EG: as is the case you pay more on excess if you're younger driver in an accident).

Vehicle modification laws are trialed and tested. Yes, people can still have accidents while being in the confines of the law however, as they are within 'what is lawful', the above examples are either minimised or do not occur.
