How lucky am i ?!?!

Post by barfy »

Hey Guys,

Had a lucky break last night, was coming out of a round about on to a long stretch of road thought i would give it abit mivec'd out of first and second and then back off abit... Was nearly home and red and blue lights started flashing in my rear view mirror ! 8O :x

At first i thought it was for not wearing a seat bealt but manage to slip it on while he was in his car punching in my rego. Anyway he comes to my window asks me to step out of the car.

First question was....

Whats the speed limit on Smart Rd ( the road i gave it abit on :D ) i replied ummm 60

He replies now my next question will decide how far i take this...

What was the speed u were doing ?

Ummmm 80 or 90 :x He goes yeah i would say atleast 90, i said although the motor may have sounded like it was going faster  hehe

You know your looking at atleast a $300 fine and loss of your licence ? No i didnt realise that :x

Ever been in trouble with the police before ? No
Ever had a speeding ticket ? No
Would you like this to be your first tonight ? No

Well keep your speed down ! Your car looks as though it has abit of speed behind it but dont speed !

Hands back my drivers licence gets in he car and drives off

I drove home thinking how lucky am i !?!?! 8)

Even without a camera or speed detector they can give you a ticket if you admit to speeding and tell them what speed you were doing, hence why they generally ask "what speed were you doing?"

I believe that if they follow behind you for 2 minutes or so while you are speeding, they can still get you without a radar or an admission. Can anyone confirm or deny?

they still wouldnt be able to prove it? u could just say... "i was doing the speed limit" they'll say "we were following you and u were speeding" then u be childish and say "no i wasnt" and it'll just go round in circles unless they "we have u on camera" and u say "prove it" if they show u then just accept it.. if they cant then they cant prove u were speeding at all :P

Yes & then the cops will defect every little bit of mod that you had on your car.

According to the TOG cop at the Melb photo shoot, a stop watch and two fixed points on a road (e.g. tree, sign, bridge) can be used to determine your speed. So if they were following you in a car, they could use this method.

a cop can book you as they are classed as experts of motor vehicle speed and sh*t like that, so they can give you a ticket if they were just cruising along with no camera or radar......
Also with defects they can defect a car even if you can wiggle something on a car.... ive been told by a few cops that if they really wanted to they could defect a car straight off the showroom floor!!
Going sideways at 140km/h isnt as fun as it sounds!

yeah, I've heard the same thing as well. I've also been told be police that they only need to follow you for a certain distance and they can fine you. And yes you could probably argue it at court I would think they wouldn't have the evidence and you could argue all day about the accurace of speedo's but still in court I would think it would be hard to have a judge believe you over a cop in a traffic matter.

A magistrate will believe the cops evidence as they have 'expert opinion' when it comes to speed.
* only the highway cars have the speedo calibrated
* normal cops can book u just the same
