no spare wheel defects only apply to cars that come with them. its the same with the backseat, trims... all that crap. if youve taken anything out thats meant to be their from factory without mod papers, an officer can defect you for it.

OP - i can see your side of it and would like to suggest you contest it BUT sometimes its easier to cop it on the chin... especially if its a small fine or defect.

nar undercover ba flacon wagon no radar no computer just lights i called gosford police station to ask if it was a real police car they cant comferm with out a number plate and theres nothing in the system yet im gona park my sisters car inbehind mine for a while just incase untill i least get a fine and im gona contest it cause its all bullshit serched car with out asking didnt give me my licence back gave it to my mate tail gating him speeding in unmarked car gessing a speed cause he had no idea never showing his badge when he pulled up behind my mate he was doing the limit and theres no way he can judge while he was doing 120 to catch up

ok so I got the fine in the mail today not to happy bout it so taking it to court my mate hasn't gotten his yet so gona wait a week see if he gets one and weigh up my options question is how much will it cost to fight it if I seek legal advice the notice I got in the mail today has the wrong offence code I serched it and nothing came up what should I do

For something like this a lawyer will charge you any froom $500 - 880. So really the only course of action is to deefend yourself.

I recommend you talk to som of the guys on THIS forum as they can be quite helpful and most importantly FREE

Pay the fine and cop it on the chin. These days if you take it to court 99.6 % of the time you will still have to pay it and then some.
If you look on the RTA site at fines it will show you what you may have to pay if they don't overturn the fine, then you have to add legal fees on top.

it's the principle of the thing ;)

Although, my brother went through this & could prove that the cop didn't have a radar (claimed he did - all he had was a top speed for his speedo frozen & the judge sided with the cop.)
They'll claim they had to do 120, 180kph to catch up to you or whatever and the judge will always take the cops word over yours - you need other witnesses, or better lawyering skillz.
I always think that it's BS that a cop is allowed to go 120 in a 60 zone to pull you over if they want, even if you were only doing 10 over the limit - how is it safer to have a high speed car chase than for a person to go 70 in a 60 zone?

a few bits of information that i know of are;

You need to show that the radar hasn't been calibrated on a regular basis (I dunno about cops speedo's needing it done)
This goes for speed cameras as well - there is a set schedule for when it should be done & they often don't do it.

Use the time that your mate was pulled over & ticketed & the time that you were pulled over & ticketed & then let the judge work out that you pulled over of your own free will waiting for your mate & it would be proof.. (assuming they have the time on the ticket, not just the date)

well I was pulled over befor my mate I think ill just take it to court and take him with me as a witness and see how I go im willing to pay the money cause if I get done again if I pay this I lose my job and licence and car so would rather take the chance now as its pretty dodgey rather then some thing I can't prove was dodgey cops think there above the law if I lose ill put charges agaist the cop for giving my licence to some one else I called gosfod satation the next day and they didn't even care as long as I got it back rta said its nothing to do with them

Cop it on the chin.

All it will take is the judge asking you - "were you speeding" and then you've got two options: drop the matter and cop it, or lie to a judge.

Ok well I would say that you did not check out the RTA site about what you would pay for a fine if you lost in court so here is a link for you.

I was under the impression you can't be forced to be a witness against yourself? So if you chose to not answer it wouldn't be a lie.

Of course that will make you look slightly dodgy... but they would still need to prove that you were speeding?

Mate, I don't know, and don't profess to know much about the legal system. I guess the point I am making is that people who take risks and get caught out, should be man (or woman) enough to own up and take the punishment.

To my mind, that is the real issue.

its simple....... 'a bad driver is worse than a fast driver' im not quoting anyyone i just thought it deserved quotation marks. cops can defect any car, ive worked at 4 different mechanic workshops and i c the sh*t they have to look at foir roadworthy, i know people that have been done for nothing... no water in wahser bottle, obstructing the windscreen is becoming popular (gps, air freshner BIG FLUFFY dice haha), for the record u can get a vehicle roadworthy without a spare tyre as long asif u have 1 its pumped up thats the law in vic. everything for a cop to defect or to pass a roadworthy is about saftey nothing else.

example: u could get a holden barina runnin on 3 cylinders, with no back windscreen roadworthy but u wouldent b able to get somehthing roadworthy if your brake disc rotor was 1/10th of a mm thiner than the legal requirement (about 50kms of driving's difference) no matter what the car

this has a direct relation to defects as they SUPOSEDLY abide by the same rules.
if u dont get caught its not illegal and if they cant prove the same goes but they know it will cost u heaps to contest especially if u lose so either way they win and u lose such is life.
