On Friday night at about 8.30 my girlfriend and I were driving home in my GF’s Mazda 323 sp20 along the city west link road towards Parramatta Road. Travelling at approx 60km/h we felt a huge smash in the back and we got pushed in to on coming traffic. I was in the front passenger seat and grabbed the wheel and pulled us back in to our lane. My GF started braking and we came to a stop in lane 2. No other traffic was travelling in our direction. I ask my GF if she was ok and she said she was. I looked out the back window (which was gone). I see a massive land cruiser ute facing the curb. He then reverses and positions himself at the nature strip and I can tell he’s going to do a runner. I get out of our car and run across the road and then through the nature strip. The ute smashes over a tree and switches his lights off and takes off up the road. I couldn’t see his rego plate and carry on running up the road after him but he didn’t stop and I lost him. I was going to keep going but had to go back to get my GF out the car. She was in tears when I got back to the car but we managed to walk back to the curb. We both have whiplash and lower back pain and no idea who the f**k hit us.

Have a look at the pictures and remember that we were doing 60 and not breaking when this wanker hit us. Cops were called but were useless. I’ve attached pictures of the type of ute that hit us. If you see one around with damage to the front, please let me know. Thanks.

That sucks mate .. Well, luckily you were not t-boned by oncoming traffic or anything ...

You can back it in that the guy was either drunk, or has some reason to run from the cops... Hate people that cause accidents like that, and then take off... Just like people that run into your car when parked and do the bolt ... GRRRRRRRRRR!!!!!!!!!!!

The City West Link may have some tidal flow camera's ... Check the RTA website... If they do, see if you can get the cops to either look into it, or tell the RTA what happened and get them to look into it for you ...

I have a pretty good set of solicitors if you need them ... They do traffic stuff, and also criminal cases... PM me if you want their details...

Man thats bad :cry:

Did you call the police straight away? You and your GF should do a check up if you haven't done so, god forbidd but sometimes minor accident can cause more then just a whiplash and back pain.

It happen to me before but it was at an intersection where driver have to stop and i was at the intersection waiting for the light for 1min already.

Hope someone catch that bastard soon and put him in jail for 1yr or two :evil:

Thanks Rock It, I've just emailed the RTA now.

Yes FTO338, police were called straight away but didn't seem interested. They were fresh out of the academy and were pretty useless. I don't think they will try and do anything about it at all.

We both work together so are going to see if we can get workers comp as it was on the way home from work. Thing is, we went to the pub first (my gf doesn't drink btw) before heading home. Will this affect our chances?

No probs ...

With the workers comp ... I think it will affect the outcome ... If it is not a direct route from work to home, then you are not covered. From my experience, the only time this is OK, is if it were a work function at the pub (E.g. farewell drinks, Christmas Party etc.), or if it were part of your daily duties. Like going from work - Picking up the kids from day-care - going home. As that is your direct route to get home (and you pick the kids up consistently) it becomes part of the route...

But workers comp laws do change all the time.. I had to do many OH&S + Workers comp courses as I manage others...

If the cops do not do anything about the incident, it is important to remember that you do not have to stop the wheels of justice... Get a solicitor, go to the Police Ombudsman, and get the cops @sses kicked for not pursuing... The Ombudsman is a good option as it is a free service... I think you can find out more info about the Ombudsman and stuff on any search about making complaints, or pursuing matters regarding the Police Force... May even be on their website, or Government website as they have to document the process formally ...

Other then that ... Good luck and I hope you catch the bastard ...

From experience, i don't think your chances of getting Workers Comp or avoiding a Excess bill for fixing your car from Insurance company aren't very good.

Pursue it though as your luck may be better than mine.

I was taken out in a much more serious incident were a Unlicenced "P" plater ran a light at 80km/h and smashed into me (i was doing around 70-80km/h) too which wrote of my WRX showcar, put me in hospital and wrote off four other cars.

But, check this, i got charged for the incident !!!

So, now i'm very sceptical about getting help when anything goes wrong as even though it's not your fault, it can be twisted anyway the authorities want to twist it and there isn't a thing you can do.

Sorry, i;m just a bitter man since my incident.

It was a fairwell gathering at the pub, so maybe? I have a friend who works for the Cross City Motorway and I've asked him to check the camera's between those times, just in case he went through there before hitting us. It's a long shot but you never know...

When we called the police, we told them which direction the ute went but the cops didn't come from that direction to get to us :roll: Then they breathalyse my gf. We've been hit in the rear. Whitnesses see the ute drive over the nature strip and drive off and they breathalyse the victim ...WTF!! 8O

Hmm ... Strange case in deed... RalliartBoy

If the P-plater was in the wrong, he should have been found guilty, and you should not of been charged... It usually comes down to knowing your rights... And the unfortunate thing with unlicensed drivers, is that they don't have to pay you a cent... Parents are accountable for the damages, and you can only chase the individual ... So I think your only option is a civil case at court... He gets found guilty, claims he can't pay, and then walks away ...

Workers comp won't cover the car ... Just yourself (maybe some possession's damage like a walkman or something) ...

As you were at a work event, then you should be fine... Just make sure you mention that if asked, and give the details like who the person was, what their relationship was... That you were not drinking (or the driver was not) etc. etc.

It is just protocol that the cops breath test the driver... Even though you are not at fault, it is something that they just have to do ... As for not chasing down the direction the ute went ... Well, just plain silly ... They may have called it in though, to which they may not of told you ...

Usually with accidents too, it is first car to respond to the call over the VKG ... So they were probably closer to you then any other units... Which would explain why they may not of come from the direction you thought they should... I just really hope they put a call out for the other vehicle when they found out about it though ...

Well since you didn't went home straight away and went some where else, then i don't think you have a good chance of workers comp.

of all the landcruisers it had to be a white 75 series, the most populated of all. did it have a bullbar, did it sustain much damage to his front when he hit you? was it a standard model or did it have a lift kit/ oversized tyres/ spotties etc? see what colour the plates were ( know what state he's from at least). stupid bogan feral pricks :evil:

As for the type of ute. The photo's I've attached are almost identical to the one that hit. The tool boxes in the back, bull bars. It did have a snorkle though. Yes, it had the lifter kit and massive tyres. Not much damage from what I could see but he was driving fast and all over the place. I'm mad at myself that I didn't see the plate. The thing that gets me too is I'm sure there was someone else in the cab with him.

Couldn't tell. How would I know? I can't remember what it sounded like. It took off pretty quickly, I couldn't catch it and I'm not a slow ruuner at all. It had enough tourque to take a small tree out of the ground with not too much speed behind it.

Might be a longshot - but if he had a snorkel and was lifted - he may be into 4wd'ing - maybe drop a line to the TLCC (Toyota Landcruiser Club) - if he damaged his bar - he may be after parts http://www.tlcc.com.au/tlcca/ they are a pretty decent mob with a huge membership base.

Damn dude.... that sucks... :( I can't believe assholes like that... your girl could have been seriously injured & they just drove off...

Sorry to tell you this but.... I think that even if you can find one of these utes with Front damage, you won't be able to prove anything... unless you got the plates, or at the very least a good description of the driver etc they will have gotten off scott free :( There is not much that the cops can nor will do...though if you do see one with fresh frontal damage then I think that it is safe to say you've found your guy... ;) ....nuff said i think. :evil:

Well the cops can do something if they can be bother, they can analyze the paint residues left on the bull bar from the accident and check if it match to AJ gf's car.

hehe, i think you've been watching a bit too much CSI ;) lol *jokes*

They probably 'could', but you could count the amount of 'good cops' on one hand ... the rest couldn't be bothered ... that would actually involve some real police work ... and they'd actually have to find them first!
besides, theres so many jaywalkers & import car drivers out there to bust, way easier than going after the real crims :x
