I'd be curious to know who accepted the offer first; Sahin can you confirm this?

In any case, does anybody know of someone selling a cheap FG or CF bonnet? preferably Melbourne?

But seriously, did you say you'll buy it before I did? Technically speaking, it can't be sold to someone else after the offer has been accepted. Not arguing, but I genuinely needs a bonnet! (fg or cf would be nice =P)

Unfortunately a sale is never final until the cash has been exchanged...

I have seen on other forums where people have paid a seller, only for him to turn around and sell the item to someone else for a higher price... Then refund the other person they charged originally...

At the end of the day, if the seller is a douche there is nothing you can do ... Not saying that is the case here though ... Just generally speaking..

EFA. That's the principle I follow. Having said that, I believe in dibs and a seller's and buyer's honest word of commitment.

I messaged Sahin and put a deposit through just after the post went up.

+1

But, obviously, some other people are just douche bags.

Well legally speaking a sale is entered into a contract once an acceptance has been made to the offer. Calling "dibs" would be classified as a counter-offer which would then give the power back onto the seller on whether he or she would then like to accept the counter-offer...actually i have no freaking clue what "dibs" would be counted as.

...anyway, FTOOwnage that's all good mate; I wasn't really interested in that particular bonnet; it just appealed to me because it was so cheap for CF.

Looks like bonnet shopping again for me! :D

If it means anything to you, I messaged Sahin at precisely 8:42 EST on the 9th.

And offerred a deposit straight up that evening.

How am I a bad bloke for buying a bonnet? :?

Sorry, I'm known for taking things a bit personally.

I just don't like being unjustifiably called a bad person.

Well if you want to play that game......
A sale or contracts as it is known in legal lingo is an enforceable agreement only when the two parties involved come to a mutually accepted agreement, and the actual exchange of goods and or services happens.

You will find that my advertised “offer” is, in the eyes of the law, actually an “invitation to treat”. Basically it is an invitation for you to offer me my asking price. At this point it is up to me if I decide to accept or reject your offer.

“DIbs” is BS in the eyes of the law because all you’re doing is making the offer to the seller for there advertised price. It is then up to the seller to decide what happens next.

With that being said, I am a believer in the dibs system because it is a fair way to do business. But as stated earlier HeRo, FTOOwnage was the first to make contact regarding the bonnet, and an agreement was formed between FTOOwnage and myself with sahin acting on my behalf as my proxy. So in essence FTOOwnage had first dibs

The bonnet is now sold and I would like to consider this matter over.
