dude, seriously LAWYER UP!! You could have DIED!!! Even worse, you could have KILLED PEOPLE ... I know it wouldn't have technically been your fault, but you would have had some pretty heavy charges against you .. like vehicular manslaughter or whatever.. not to mention the passengers you had in your car.. you must be going through some major emotional distress right now..

They've taken 100% responsibility! You have a case against them & they know it ... offering you some free wheels is an insult to your intelligence.. go see a solicitor & see what they have to say mate.. I'm not just saying this because of the $$$ you'll get from taking some action on this, they really should be held accountable for this, otherwise the next person with those wheels may not be as lucky as you ..

Go for a hefty settlement & to get ALL of those wheels recalled & taken off shelves on the manufacturer's dollar.

My guess is that the rim 'bounced' into its box from the manufacturing line... AJ said it - quality control.

You know what .. That does make sense....

As you said previously, it was luck that you took that way home, and were at that round about when it happened. If you had of gone the other way and come off the cliff, I am sure that you would take further action .... So why let this be any different....

What if, this happens to someone else ????? They may not be as lucky as you ???? The company seriously needs to look at the quality of materials, plus their in house testing before any of there wheels go out the door... Imagine if this happens to someone going around a corner on a highway ... Doing 110 ... It would kill them .... THEIR WHEELS ARE NOT SAFE !!!! You need to raise that as awareness so that this does not happen to anyone else.....

But the fact that nothing happened means that all they can do is offer him a new set of wheels...emotional distress is one thing...but you will have to put up a fair bit of money + if this is a big company, they will not just give you money for nothing. Think about it, court is not cheap, neither is hiring a lawyer, only do it if you have some money to burn, otherwise the case could go the other way. I have heard of cases (not exactly like this) but, where the judge thought of it as nonsense (no one was harmed etc). If you need to check up some precedent .... www.austlii.edu.au
check up the cases and see if any of them have anything similar to what has happened to you.

too much law and order. What is he gonna claim? "My ego was dented...its sucks or something bad COULD have happened?" its a civil case so whats the damage to you? fark all and hence its not going to amount to fark all. You have to prove it was their fault. One issue will not result in a recall unless you prove it is a sestemic problem How do you do this? experts, time ffort and money.

If you get cheap cast china rims. porsche and audi use them on the cheap when they cut cost on the cheap models otherwise they use decent bands like BBS. You take the risk with these thin cast china jobs...no drama with 6+ spoke on decent cast or forged rims..although on such a light car its a suprise it happened. You are getting you new ones possible the most suitable outcome and move on.

Totally sh*t quality control...I wouldnt even risk it with a new set if I was you and tell you to pay you the money.

believe me i know everything that i could and can do, i have sought legal advice, advice from the FTA and The CAAA,

I have no contract with the company that put the wheels on the car, therefore, i cant "sue" them, my contract is with the suzuki dealership, they are the ones who sold me the wheels (on the car)

and i know they are shitting themselves :) they told me to write out a list of everything i want on it and they'll put it on for me :)

is this to try and shut me up? of course it bloody is!
BUT! I WILL NOT SIGN andy non disclosure form nor form that says i wont say anything, if they try that i wont take the car back, then i will hit them with the lawyer :)

i asked them about replacing my car with a new one and they said

"the wheel company would have to take thatresponsibility and they way they would have to do it is trade the car back in and pay the difference on the price of a new car"

BUT!

like i said, my contract is with suzuki and not BSAWheels,

however they are going to put everrything on "MY" car that i want so why would i want another car?

im just writing out a list of everything i expect at the moment, ill post it up later before i send it to them... watch this space!

btw! IM SERIOUS ABOUT THE COMP! 100 bux boys! also, now theyve said i can have any wheel i find! yeaaaaaaaaaaaahhhhhhhhhhhhh!!!!!!!!!! :D

they are an Australian company, and all their rims are australian made,

and they should recall the wheels, they are model G2-78, one failure is enough for a recall, if something else happens (someone braks one on the m5 or something) and the pigs find out they knew there was a problem and they would be in the.....

they are an Australian company, and all their rims are australian made,

prove it was a design fault or manufacturing fault in that batch only or in fact it was just mis-handled. Will that warrent a recal?

I'm all for a recall, totally sucks and could ahve been much worse...

but I'm afraid its one of those things which will be more effort for you...and probably cost..

you can just get what you actually want to start off with...in the end your choice...

nah i think ill go something 18' light, black, maybe the AU340 or the AU249boption for a bit of sparkle.... but then, it is girly enough

ebay ?? im sure there would be a few people looking for those kinds of wheels...especially if they are cheap ! You can also put up one of those ads on quicksales.com.au i have seen license plates sell for well over $100k on that...and also wheels selling well over $5k !

if they said any wheel you want come and join the uber volk racing circle, good luck finding stronger lighter rims, mind you you are in a swift now and rims that are cooler then the whole car might be ova kill :roll: nah mate thats my opinion anyway, glad your still alive to pick a new set of rims good luck with your search, ive made my recommendation still, nothing on that other site tickles my fancy but a nice set of
