help contesting a fine in nsw
Hey guys i just got fined for not having my battery secured and also not displaying my p plates when i got pulled over...
now i agree with not having the battery secured, i understand its my bad, ill pay that one...
but the P plates, i had them clearly displayed, but the police officer still wrote me a ticket for it, i really dont agree with this
how do i go about contesting this fine? am i able to ask for photographic proof?

u should have argued the p plates at the time and how did he know you battery was insecure? did he make you pop your bonnet? id argue that 1 too, if its connected and under your bonnet its not going to go anywhere so as far as im concerned that is secure. is there a writtn definition you can dig up somewhere?

The battery has to be clamped down to pass a blue slip. The battery also has to be the right size. When my car was blue slipped they needed to upsize to a bigger battery to make it road legal.
My P-plates were bought from a repco. They're made of perforated plastic which makes them harder to see. Stuck on the inside upper lefthand side of the car, front and back. I've never been given any problems by police because of their location.

regardles of what is specifcially written the rule is interptrted such that it needs to be firmly clamped down to be secure...
just hanging on from your +ve and -leads is crap anyway, as if it is moving you putting undue stress on them which - and I'm not saying it will but - could eventually snap off...not cool when your in traffic..
do it properly, secure it, dont let your power cables take any force its a bad idea peroid.

i got booked a month back (now i remember abt this fine.. and its overdue! f***! lucky u made this post) for doing a u turn on a EMPTY intersection and it didnt say "no u turn" but anyway when i got pulled over i didnt have my P plates on at the back, and the one at the front was half hidden away in my front corner of the windscreen.
the guy said its not clearly visible at the front and i said yes i agree but i have nowhere else to put it. so i took it off, and showed him how i cant stick it anywhere on the front as much as i'd like to and he said then that's fine.
plus he let me off for not having one on at the back, so in the end i suppose it depends on the cop.. i got let off ez, and u got done hard but i dont think u can argue it bro.. in the end it says "behind tinted windows" and u have tinted windows, then u can't argue it.. i guess u can say what i did - there's nowhere else to put it! but that's abt it.

I will say it again...
your driving an import car..if u got busted for something I'm sure they missed something else. Drive a car that stands out and expect to get attention from the cops.
if you do something wrong or against the law then why complain? All they are doing is upholding the law, u know its wrong yet wonder why they fine you...as for driving on the wrong side of the road well your the one to blame. It you car is stock hight then why was there and issue its not that low mate.

I've seen SS Lowered to the FLOOR cops drive straight past and WHAT i rive down the road and Stock and all and i get pulled over!

dont do the wrong thing and then you will not be in trouble. I've heard these stories 100 times in this an other forums - i didn't do anything blah blah. but u did, and admited it so get over it. Its your fault mate not theirs and maybe if u didn't give him attitude (which I high doubt anyway you were probably shitting your dacks) he might have left u off...

Fill in the court election details on the back of the fine & everything you need will be sent to you in the mail. Get a solicitor as well. More often than not, its a hell of a lot easier to just pay the fine. Sure you may get off, but you are going to need to make a few court appearances - but what people don't realize is that their time is worth more than money.jonowong wrote:how do i go about contesting this fine? am i able to ask for photographic proof?

Well if they're on the inside of your windscreen, it should be on the lower passenger side held against the glass so it is visible from outside. If it was just sitting on your dash, then that's a no-no.
So take it from there. If you feel it was visible, then you just need to write to the Infringements Processing Bureau to contest the fine. Add a couple of pics for proof.[/b]

I got pinned for this years ago, wrote in because at the time the rta website in nsw said it was fine to display them on your windows on the dash, and then never got a reply
2 years later, my license was suspended, but I was not notified, I was then caught for driving whilst suspended. I had to take it to court, and the good news was the prosecutor decided to let me off, bad news was it costs me over 2k in legal fees.

If placing P signs on windows, they must be held against the glass, be displayed conspicuously in the lower left-hand (passenger) side of the windscreen and on the lower left-hand side of the rear facing window and must not be placed on any other part of the window area.
